East-Kazakhstan region: conciliation outside and in court

The number of cases in the courts of the region decreased by 2,300 cases in the first quarter of this year compared to the first quarter of last year. This is connected with the work carried out by the regional court to popularize conciliation procedures to no less extent.

The conciliation sectors actively work in the courts of the region. So, the sector of the Oskemen city court rendered services on 827 (148 to lawyers, 3 to notaries, and 108 to mediators) appeals of citizens by April 20 this year. With the acceptance of appeals and the subsequent conclusion of an agreement in the mediation procedure, 58 citizens' applications are for mediation. The Branch of the Family City Court rendered services for 490 appeals. Of these, 414 to attorneys, 11 to notaries, 37 to mediators. With the adoption of applications and subsequently the conclusion of the agreement in the mediation procedure, 2 appeals were considered.

The virtual mediation office created on the basis of the Internet portal of the House of Friendship helps citizens settle their disputes without appealing to court being at work or at home. To do this, it is enough to register on the portal and send the application online. Out of 128 applications received via the virtual mediation office, 124 are concluded with the conclusion of mediation agreements.

The Center for Pre-Trial Settlement of Disputes and Conciliatory Procedures is set up in the House of Friendship and the Center for Public Consent, where services are provided free of charge to vulnerable sections of the population. Since its opening, the Center has settled 20 disputes, including 5 with the conclusion of mediation agreements.

A professional mediator works in the mediation office of the Oskemen Labour Union Council. Here, services are provided and of an advisory nature, a training workshop themed ‘Negotiating process in the work of the conciliation commission’ was held to prevent labor disputes.

In January 2018, the Mediator's Corner was opened in the Center of Oskemen. The mediator on duty informs visitors about the benefits of conducting the mediation procedure, provides information and advisory and legal services, disseminates the handbook "How to choose the right lawyer and protect yourself", information booklets and methodical recommendations "Conciliation procedures at all stages of the process".

Courts of the region conduct activities to clarify the essence of conciliation procedures on an a regular basis.

So, 25 judges of the region were trained of mediation in the "Alternative" mediation center on the general course

Conciliation Courts are open in the courts of the region.

The regional court conducted a round table discussion in February this year the participants of which discussed the issues of expanding the application of extrajudicial dispute settlement, executive inscription.

The regional court produced and set up videos "Executive inscription" and "Sector of legal services" which are broadcasted in the waiting rooms of all the courts of the region, in the buildings of the PSCs, tabloids in public places with high attendance (central city district, airport building).
