Judges discussed mediation in consideration of materials on grant of parole in Oskemen

The acting chairman of the East Kazakhstan regional court Kairat Chakpantayev conduct a round table discussion themed: "The issues of applying mediation when considering materials on grant of parole, replacing the punishment with a softer one."

The discussion was organized with the aim of expanding the scope of application of the mediation, elaborating proposals on introducing amendments to the legislative acts for the legal regulation of this issue.

The round table discussion was attended by judges, representatives of the prosecutor's office, the bodies of the penal system.

Focusing on the relevance of the discussion, K. Chakpantayev made it a point that the priority task of the judicial system in the Supreme Court's project called "7 stones of the judicial system" is the further development of conciliatory procedures. He noted the need to extend the law On Mediation and on issues related to the serving of punishment by convicts. "Taking all measures for out-of-court settlement of disputes on payment of compensation for damage caused by a criminal offense by attracting mediators, we are implementing the legal reforms of the Head of State aimed at reducing the prison population and reducing conflict in the society," he said.

As the judge of the regional court Kaken Seitov noted that compensation for damage caused by the crime is one of the basic conditions for grant of parole and replacement of punishment, therefore, it is in this matter that mediators can play an indispensable role in settling property claims of victims and finding an optimal solution for the parties. This issue was repeatedly raised by the region's mediators.

In conclusion, the participants in the discussion developed proposals for introducing amendments to the Criminal Code, the Code of Criminal Procedure and the Law on Mediation. Also, an agreement on concluding a Memorandum on the development of the mediation with the involvement of professional and non-professional mediators was reached.
