The chairman of Kostanai Regional Court A. Mergaliev: ‘Reforms will increase transparency and remedial mechanism in criminal judicature"

Having a working trip to Jitikara Aslambek Mergaliyev met with the activists and residents of the village.

The akim of the district, the first leaders of local law enforcement and state bodies took part in the meeting.

Speaking about the modernization of the criminal process and the improvement of other aspects of law enforcement activities, the chairman of the regional court explained the innovations of the draft law "On the improvement of the criminal process in the Republic of Kazakhstan" systematized in the six main priorities taking into account international experience and the specifics of the domestic legal system in details.

‘The measures taken to further reform the criminal process and improve the judiciary will increase transparency and strengthen the human rights mechanism in criminal proceedings,’ A. Mergaliyev stressed. The priorities include raising the level of protection of citizens' rights by expanding the list of grounds for which the preventive measure in the form of detention is not applied, reducing the period for bringing the detainee to court for a preventive measure up to 48 hours and for minors up to 24 hours. The further extension of the scope of judicial control in the form of authorizing procedural actions of a law-limiting nature, including secret investigative actions, simplification of criminal cases, obvious and crimes of minor gravity including the introduction of writ proceedings are also mentioned. The draft provides for giving lawyers broader rights to collect evidence including direct application to the court with a petition for the necessary investigative actions.

In his speech, the Chairman noted the program document "Bolashaqqa bag’dar is rukhani zhang’yru", its main directions and the work of the regional courts in accordance with the tasks set by the Head of State.
