The judges of the East Kazakhstan region took part in the meeting of the Committee on Legislation and Judicial and Legal Reform of the Mazhilis of the Parliament

The Chairman of the Committee Nurlan Abdirov held the meeting in Oskemen.

In addition to the mazhilismen, the judges of the region, the officers of law enforcement agencies and the akimat of the region, a number of authorized central state bodies, the Nur Otan Party, Atameken, the business communities and non-governmental organizations took part in the meeting.

Opening the work, N. Abdirov noted that only with the joint and constructive work of the Parliament, law enforcement bodies, and the judiciary it is possible to achieve and fulfill the tasks set by the Head of State to ensure respect for the rights and freedoms of citizens, strict enforcement of laws and the strengthening of the law and order in society.

Within the framework of the execution of point 10 of the Plan of legislative works of the Government for 2017 the deputies told the present about the draft amendments to a number of existing laws, in particular, to the Code of Administrative Offenses.

The meeting heard information on the law enforcement practice of the Code of Administrative Offices by state bodies, in particular, the Ministries of Justice and Internal Affairs, the judges, the General Prosecutor's Office, the Republican Bar Association and private bailiffs.

During the meeting, the chairman of the regional court Nurlan Kairbekov made proposals to the draft law "On Amendments and Additions to the Code of the Republic of Kazakhstan on Administrative Offenses." At the same time, he noted the main task of the judiciary is to resolve conflicts and disputes arising in public and state life, the restoration of violated rights, the punishment of those who violated the law. According to N. Kairbekov, serious danger for modern society is not only the developing crime, but also the administrative violations, as a threshold for this crime. "Administrative responsibility is a necessary stimulant of law-abiding behavior and promotes the education of a sense of moral and legal duty to society and the state," he said.

As the deputies noted, the draft law on amendments to the Code of Administrative Offenses was developed in compliance with the Message of the Head of State to the people of Kazakhstan "The Third Modernization of Kazakhstan: Global Competitiveness". The bill is aimed at further humanization of administrative and delictual legislation, the systematization of administrative procedural norms and the improvement of certain administrative legal and procedural institutions. Within the humanization of the administrative and delictional legislation, it is proposed to reduce the amount of administrative fines, expand the use of the warning, revise the types of penalties in favor of their humanization, expand the scope of the reduced production, and list the subjects, including legal entities, for which the amount of the fine may be reduced within 30% of the total amount.

The law is aimed at providing a qualitative new level of protection of human rights and freedoms, the interests of society and the state against administrative violations.

At the end of the meeting, the heads of the departments made their suggestions on improving and optimizing the Code of Administrative Offenses.
